RE:: MOTION for Leave to File Post-Hearing Statement filed by Receiver Peggy Hunt. (Thomson, Michael)

 

Summary:  The judge approved the motion of leave document 57 from yesterdays filing of the receiver.
This approves their filings to complete the following document.

The following is the details that have been listed on the legal document:
Peggy Hunt, as the Court-appointed receiver in this case (the “Receiver”), by and through
her counsel of record, respectfully requests that this Court grant her leave to file a post-hearing
statement in this matter on or before November 28, 2016. In support hereof, the Receiver states
as follows.

1. On November 1, 2016, the Court commenced an evidentiary hearing on the
Plaintiff’s Motion for Preliminary Injunction, and the Defendant Charles Scoville’s Motion to
Set Aside Receivership (collectively, the “Relevant Motions”). The Receiver and an accountant
employed by the Receiver were called as witnesses by the Plaintiff.

2. The evidentiary portion of the hearing on the Relevant Motions concluded on
November 3, 2016, and at that time, the Court requested that the parties file post-hearing briefs
by November 28, 2016, at 5:00 p.m. Argument on the Relevant Motions is scheduled for
November 30, 2016.

3. The Receiver has not filed papers related to the Relevant Motions to date.

4. The Receivership Estate is an interested party in this case, and the Receiver
believes that it would be appropriate for her to submit a post-hearing statement prior to the
conclusion of the hearing.

5. Accordingly, the Receiver requests the opportunity to file a post-hearing
statement on behalf of the Receivership Estate on or before November 28, 2016.
WHEREFORE, the Receiver respectfully requests that the Court grant this Motion and
afford her leave to file a post-hearing statement by no later than November 28, 2016, at 5:00 p.m.

A proposed form of Order is attached hereto as Exhibit A.
